Programme Objective

The objective of the program consists in stimulating the establishment of new small and middle-sized enterprises, improving the economic performance of the existing ones, increasing the potential to access financing source and developing the entrepreneurial skills of the entrepreneurs in order to make them become involved in private economic structures.

This procedure institutes a transparent de minimis aid scheme.

The scheme applies on the whole territory of Romania, in all its 8 development regions.

Budget of the financing programme:

To be established on occasion of the launch of the financing programme

Eligible beneficiaries:

The provisions of the Program apply to the commercial companies (microenterprises, small and middle-sized enterprises) that cumulatively fulfill, on the date of the online completion of the business plan (annex 1), the following eligibility criteria:

a) are organized in accordance with Law No. 31/1990 on commercial companies, as amended, or based on the Emergency Ordinance No. 6/2011 to stimulate the establishment and development of microenterprises by young entrepreneurs;

b) are SMEs, according to the provisions of art. 2 and pof art. 4 comma (1) lett. a), b) and c) of Law No. 346/2004 on the stimulation of the establishment and development of the small and middle-sized enterprises, as amended, which transposes in to the national law the EC Recommendation No. 361 from 6 of May 2003, published in the UE Official Journal No. L124 from 20 of May 2003 m (have no more than 249 employees and make an annual net turnover of no more than 50 million Euro or own total assets of no more than 43 million Euros, the equivalent amount in Lei.

c) have entirely private social capital;

d) were not granted any Non-reimbursable Financial Aid within the Program in the previous years and do not have partners, shareholders or administrators who act or were acting in the capacity of partners/shareholders/administrators of other commercial companies which were granted a non-reimbursable financial aid within the Program in the previous years. The partners, shareholders or administrators who own several commercial companies may only apply, within this program, for one commercial company.

e) the administrator of the company is a Romanian citizen and is a graduate of, at least, high-school studies (a high-school graduation diploma or a certificate of graduation);

f) have been registered with the Trade Registry for no more than 2 years on the date of the online completion of the business plan and the domain of activity for which they are applying is eligible within the Program.

g) do not have debts towards the general consolidated budget and the local budgets, for the head office or the production units; the Applicants who have rescheduled debts are not eligible to access the Program;

h) have not exceeded the de minimis cap of 200,000.00 Euros in three consecutive fiscal years as a single undertaking, as it is defined by the EU Regulation No. 1407/2013 of the Commission from 18 december 2013 on the application of articles 107 and 108 of the Treaty on the Functioning of the European Union to the de minimis aid.

i) are not under dissolution, judicial reorganization, liquidation, foreclosure, operation shutdown, insolvency, bankruptcy or temporary suspension of activity; 

j) are not ''in difficulty'', according to the provisions of the ''Guidelines on the State aid for rescuing and restructuring enterprises in difficulty'', published in the Official Journal of the European Union No. C 244/2004;

k) were not the subject of a decision of the European Commission/of OTIMMC for recovery of a state aid or, in case they were the object of such a decision, it was already executed and the debt was entirely recovered;

  • production or sale of energetic products defined according to Law No. 571/2003 on the Tax Code, as amended, rental and leasing activities, investigation and protection activities as well as:

a) fisheries and aquaculture activities, covered by the Council Regulation (EC) No. 104/2000:

- 031 - Fishing
- 032 - Aquaculture

b) activities related to the primary production of agricultural products such as enlisted in Annex 1 of the Treaty establishing the European Communities;

c) processing and marketing of the agricultural products enlisted in Annex 1 of the Treaty establishing the European Communities, in the following cases:

when the amount of the aid is established on the basis of the price or of the quantity of products of this type bought from the primary producers or commercialized by the respective economic operators;
b. when the aid is conditionned to be partially or entirely ceded to the primary producers (farmers);

d) activities related to exportation, that is the aids directly related to the exported quantities, to the creation and operation of a distribution network or for other current expenses related to the export activity;

e) aids destined to the use of national products to the detriment of the imported products;

f) aids destined to the economic agents who operate in the coal industry, as it is defined in the EC Regulation No. 1.407/2002 on the state aid to the coal industry (NACE Rev. 2) 

- 051 - Mining of hard coal
- 052 - Mining of lignite
- 061 - Extraction of crude petroleum
- 062 - Extraction of natural gas
- 0721 - Mining of uranium and thorium ores
- 0892 –Extraction of peat
- 091 - Support activities for petroleum and natural gas extraction
- 099 – Support activities for other mining and quarrying

g) aids to purchase goods road transport vehicles granted to economic agents whose social scope consists in providing goods road transportation services.

Eligible expenses:

The Program finances the implementation of the best Business Plans, in descending order of total points achieved, under the following conditions:

- Non-reimbursable Financial Aid – a maximum of 90% of the value of the eligible expenses related to the project, but no more than 94,500 lei/beneficiary;
- Own contribution – a minimum of 10% of the value of the eligible expenses related to the project.

The object of financing must come under one or several of the following eligible categories:

a) Technological equipment, machines, work hardware and facilities, including the related software, needed to perform the activities for which the financing is requested, excluding mechanical, electrical, electronic gambling machines, pool tables, musical instruments and music boxes;

b) Measuring, control and adjustment instruments and systems, barcode readers, electronic scales with/without printer for labelling, electronic fiscal cash register; 

c) Goods transportation means (utility vehicles in categories N1, N2, N3, except for the off-road G-Symbol vehicles in accordance with the Order of MLPTL 211/2003 as amended) or minibuses, strictly related to the activity/activities for which the Program was accessed; 

d) the investments in intangible assets related to inventor patents, brands of products and services (franchises, eco-labeling, licenses), software for the online commerce, software needed to perform the activity for which financing is requested;

e) buying IT equipment, computer technology (PC consisting in: central unit, server, monitor, printer / copier / multi-function device, including portable systems, licenses needed to perform the activity, audio-video systems etc.); The maximum number of IT devices of any type that may be purchased is equal to the total number of employees after the implementation of the investment with a non-reimbursable component except for the activities that do not require this (for instance: Internet cafés, computer training etc.)

f) participation of the manager or of the person in charge with the export activities of the SMEs in international training courses on export techniques. The approval of the expenses is given only if the option to participate in courses was checked on the enrollment application and the participant attended at least 2 course themes;

g) buying goods specified in the subgroups 3.1 furniture, 3.2 Office automation and 3.3 human and material value protection systems, according to the Gov. Decision No. 2139/2004 for approval of the Catalogue on the classification and normal duration of operation of fixed assets, as amended; 

h) realization of a website to present the activity of the applicant and of the promoted products and services (including the expenses for the registration of the domain, without hosting), for the economic operators who do not own another website and which must be functional on the date the NFA issue request is lodged, within the maximum limit of 1000 lei;

i) buying specific systems/equipment in order to achieve energy savings as well as systems that use renewable/alternative energy sources to streamline the activities for which the financing was requested;

j) Entrepreneurial skills development courses - for the partner/the administrator of the applicant company, a course organized by an authorized accredited body of entrepreneurial education within the maximum limit of 4,500 lei. The eligible training services providers within the Programme may only be authorized training services providers that shall present supporting documents for the qualification of the training personnel in the specific field;

k) online advertising of the activities of the commercial companies, drafting and production of printed advertising materials for the activities performed by the company, on paper and as electronic files within the limit of 15% of the value of the eligible expense excluding the advertising and the consultancy

l) consultancy on the drafting of the documentation for financing within this program and implementation of the project (a maximum of 5% of the eligible/reimbursed value of the project, excluding the consultancy). The consultancy expenses shall not be considered when applying the percentage. The eligible Consultancy services providers may only be authorized consultancy providers having as an authorized activity on of the activities included in the NACE code class 70.
